Poland’s Experience in the Face of the Rule of Law Dispute: From 2015 to 2024

Abstract. The article examines an account of the events from 2015 to 2024 related to the conflict between the government of the Republic of Poland and the European Union’s institutions, as a result of the reforms introduced in the functioning of the judiciary. The study focused on the main aspect of the dispute related to the changed procedure of Poland’s judicial appointments. Furthermore, it analysed the European Commission’s Reports on the rule of law in Poland from 2020 to 2024 and selected relevant rulings of the European Court of Human Rights and the Court of Justice of the European Union against Poland. The Polish dispute over the rule of law is a broad issue, and not all of its aspects can be presented in such a short study. However, an attempt has been made to capture its primary aspects and show how the rule of law is evolving in the EU forum. The conclusions highlight a broader context of the dispute against the backdrop of the accelerating process of European integration and possible proposals for changes to the Treaties.
