The Crime of Human Trafficking. Presentation, Controversial Aspects and Delimitation from Other Crimes

Abstract. The author proceeds to an analysis of the crime of human trafficking, which was taken over from the special legislation and which for the first time is regulated in the Romanian Criminal Code. A classical analysis of the crime is carried out by presenting the legal and material object, the objective and subjective side of the crime. A series of decisions handed down by the Romanian High Court of Cassation and Justice regarding the crime of human trafficking is presented. The author analyses almost all controversial issues discussed in the legal literature or in judicial practice regarding the crime of human trafficking. In the end, the author proceeds to analyse the relationship between the crime of human trafficking and other crimes such as deprivation of liberty, migrant trafficking, child trafficking, or pimping.
